Maine Judge Temporarily Halts Decision on Trump’s Ballot Status, Awaits Supreme Court Ruling in Colorado Case

In a recent development, a Maine judge has temporarily paused the decision to remove former President Donald Trump from the state’s presidential primary ballot. Secretary of State Shenna Bellows had initially ruled Trump ineligible, citing the insurrection clause in the U.S. Constitution, pointing to his role in the January 6, 2021, attack on the U.S. Capitol. However, the judge decided to await the U.S. Supreme Court’s ruling on a similar case in Colorado before finalizing the decision.

Trump’s legal team had appealed in state court after Bellows’ decision, seeking a stay on the proceedings until the Supreme Court decides on the Colorado case. Although the judge denied Trump’s request to stay the proceedings, she instructed the secretary of state to await the outcome of the U.S. Supreme Court case before making a new ruling.

The judge emphasized that the issues raised in the Maine case mirror those in the Colorado case, aiming to minimize potential inconsistencies in decisions and promote predictability leading up to the primary election.

Bellows, a Democrat, had previously determined that Trump did not meet the ballot qualifications under the 14th Amendment’s insurrection clause, becoming the first election official to bar Trump from the ballot on these grounds. The U.S. Supreme Court has yet to rule on Section 3 of the 14th Amendment, which prohibits individuals who “engaged in insurrection” from holding office.

The decision in Maine adds another layer to the ongoing legal battles surrounding Trump’s eligibility for the ballot, as similar cases unfold in other states, including Colorado. The U.S. Supreme Court is scheduled to hear arguments on the Colorado case on February 8.
