Donald Trump’s legal team has urged an appeals court to overturn a $454 million civil fraud judgment against him, labeling the decision by New York Attorney General Tish James as an “unauthorized, unprecedented power-grab.” The judgment, which poses a significant financial threat to the Republican presidential nominee, is currently on hold pending the appeal.

Background

The substantial financial penalty was imposed after Justice Arthur Engoron found in February that Trump and his company committed fraud by inflating his net worth to secure favorable rates from banks and insurers. The judgment also implicates Trump’s adult sons, Don Jr. and Eric, along with several business associates.

Appeal Arguments

Trump’s lawyers argue that Engoron’s decision was “erroneous,” asserting that the judge struggled with basic banking concepts and wrongly rejected an appeals court decision on the statute of limitations. They emphasized Trump’s prowess in real estate, portraying him as one of the most visionary developers in American history. Additionally, they argued that no financial institutions were harmed by the transactions, noting that these entities profited and expressed eagerness for continued business with Trump.

Response from AG’s Office

A spokeswoman for AG Tish James’s office dismissed the appeal as a reiteration of old arguments, expressing confidence in the original verdict based on the facts and the law.

Next Steps

The appeals court has scheduled oral arguments for early September. It remains uncertain whether a ruling on the appeal will be issued before the November election. This civil fraud case is one of several legal challenges facing Trump, who has indicated in court filings that he lacks the cash to satisfy the judgment.
