President Joe Biden’s sweeping pardon of his son, Hunter Biden, has ignited a contentious debate over the use and scope of presidential clemency powers. The “full and unconditional” pardon, announced Sunday night, absolves Hunter Biden of any federal crimes committed between 2014 and 2024, including potential offenses beyond the specific charges he was facing. “This was an improper use of power,” said Sen. Gary Peters (D-Mich.), adding that the move risks eroding trust in government institutions.

The Hunter Biden pardon could have significant implications for President-elect Donald Trump, who now has political cover and legal precedent to issue sweeping clemency. Trump has already hinted at using the pardon power to protect allies, including Jan. 6 defendants, a controversial promise made during his 2024 campaign.

Shortly after Biden’s announcement, Trump took to social media to question if the pardon covered Capitol rioters, describing them as “hostages” in line with his narrative downplaying the events of Jan. 6.

Legal experts suggest Biden’s rationale for pardoning his son—invoking fairness over accountability—gives Trump room to argue for broad clemency for his allies.

“This provides him [Trump] with a justification on a silver platter,” said Ty Cobb, a former White House lawyer under Trump.


Democrats React to Biden’s Controversial Decision

The pardon has left many Democrats uneasy, with some openly criticizing the president’s decision. Sen.-elect Andy Kim (D-N.J.) expressed disappointment, noting that it “feeds into so much of the distrust in politics.”

Meanwhile, Trump allies view the pardon as a template for shielding figures like Carlos de Oliveira and Walt Nauta, both of whom are implicated in Trump’s classified documents investigation.
