The special grand jury’s newly revealed report highlights recommendations to indict a broader array of figures connected to the election subversion effort. These include:
- Senator Lindsey Graham: The South Carolina senator faced scrutiny for his post-election efforts to contact Georgia election officials.
- Former Senators David Perdue and Kelly Loeffler: Both from Georgia, these former senators were also recommended for indictment.
- Trump Adviser Boris Epshteyn: A member of Trump’s inner circle, Epshteyn was among those suggested for indictment.
- Former National Security Adviser Michael Flynn: Flynn, a prominent Trump ally, was named in the recommendations.
- Attorney Cleta Mitchell: Mitchell was also among the figures recommended for indictment.
The special grand jury, operating under unique Georgia legal provisions, did not have the authority to issue indictments directly but was mandated to provide recommendations to District Attorney Fani Willis. She then pursued charges through a conventional grand jury, and notably, Trump and the other 18 defendants indicted in August were all part of the list identified by the special grand jury.
Dissent and Split Votes
The unsealed report reveals some divergence of opinion among the 23 special grand jurors and three alternates assigned to investigate the election-related probe. The panel categorized alleged crimes into seven segments, voting separately on whom among the Trump associates should face charges within each category.
While the majority of jurors supported charging most GOP activists who impersonated false electors with fraud, they were evenly divided on whether these same individuals should be accused of participating in a racketeering conspiracy. Notably, the panel did not recommend charges against three GOP activists who joined the false elector slate.
In the case of Trump, the panel took eight distinct votes related to various alleged crimes. In every one of these votes, one juror opposed recommending an indictment against Trump, and some votes also garnered one to three abstentions.
Future Indictments and Trial Schedule
It remains uncertain whether District Attorney Fani Willis will pursue indictments against the individuals who have not yet been charged. Willis scheduled a trial for Trump and his 18 co-defendants on March 4, but the trial schedule is subject to change.
Senator Lindsey Graham previously resisted testifying before the special grand jury, arguing that he was exempt from compelled testimony due to constitutional protections for members of Congress. However, he eventually appeared before the panel, with certain limitations on the topics he could be questioned about.
The recommendations by the special grand jury have alleged that Graham, Perdue, and Loeffler, along with dozens of others, were part of a “national effort to overturn the 2020 election.” The precise basis for these recommendations remains undisclosed in the report, which does not provide further elaboration on the reasoning behind the findings.
