In a court filing, Trump’s attorneys contend that the ongoing election season, with opposing candidates inherently at odds with each other, would create extraordinary hurdles in the jury selection process and impede the defendant’s ability to receive a fair and unbiased adjudication.

Trump’s legal strategy is aimed at delaying the trial as long as possible while anticipating favorable changes in the legal landscape. If successful, it would not only postpone the potential for a lengthy prison sentence if convicted but also offer Trump constitutional and legal tools to disrupt the prosecution’s efforts. This move represents the first significant test for U.S. District Court Judge Aileen Cannon, who is already deliberating special counsel Jack Smith’s request for a December 2023 trial, which he argues is in the public interest and should commence at the earliest opportunity.

The defense filing highlights a range of potential conflicts and ongoing proceedings that would make it exceedingly difficult to prepare for a trial in the coming months. Notably, it mentions a civil trial scheduled for October in New York involving an attempt by New York Attorney General Letitia James to impose significant restrictions on Trump and his businesses for alleged widespread fraud. Another complication arises from a criminal trial in March 2024, where Trump will face state charges related to payments made to adult film actress Stormy Daniels just before the 2016 presidential election.

Moreover, Trump’s personal aide and co-defendant, Walt Nauta, has four criminal trials scheduled before December, including cases involving violence against police officers during the January 6, 2021 events, and the trial of former Trump aide Peter Navarro, charged with defying a congressional subpoena.

While prosecutors view the case against Trump as relatively straightforward, given the complexities inherent in prosecuting a former president, Trump and Nauta’s defense attorneys argue that the trial will be extraordinarily complicated. They anticipate unprecedented rulings will be required from Judge Cannon regarding the handling of presidential records, the validity of the special counsel’s investigation, and other pertinent matters.

In their filing, the defense team does not address the potential scenarios if Trump were to win the election. However, they do highlight the need for complete transparency throughout the trial, insisting that no evidence should be kept from public view when prosecuting a leading presidential candidate by his political opponent.
