ACLU Joins Trump’s Fight to Remove Gag Order, Citing First Amendment Rights

Former President Donald Trump’s efforts to lift the gag order imposed on him have found an unlikely ally in the American Civil Liberties Union (ACLU). The ACLU contends that the gag order infringes upon Trump’s First Amendment right to free speech and the public’s right to hear his statements.

Gag Orders Challenged

Trump was subjected to gag orders in two prominent legal cases: his federal 2020 election case in Washington and his civil fraud trial in New York. In the latter, Trump received fines for violating the order. The ACLU’s involvement centers on the federal case and its implications.

Constitutional Clash

The constitutional debate surrounding gag orders is long-standing. Critics argue that they impede First Amendment rights, while proponents maintain that they are necessary to uphold the defendant’s right to a fair trial under the Sixth Amendment. Anthony Romero, the ACLU’s Executive Director, warns that allowing Trump’s free speech rights to be curtailed could set a precedent that endangers the voices of even those the ACLU supports.

Gag Order’s Impact

In New York, where the gag order is actively in place, Judge Arthur Engoron has warned of potential imprisonment if Trump continues to violate it. The order restricts Trump’s criticism of the courts and the justice system, sparking strong reactions from his supporters.


The collaboration between Trump and the ACLU in challenging the gag order raises significant questions about the balance between free speech and a fair trial. While the gag order has temporarily been lifted in Trump’s federal case, the legal battle over this contentious issue is far from over.
