In a letter released on Friday, Durbin and Sen. Sheldon Whitehouse (D-R.I.) urged Chief Justice Roberts to ensure that Justice Alito recuses himself from any cases related to the 2020 presidential election and the January 6th attack on the Capitol. “We urge you to immediately take appropriate steps to ensure that Justice Alito will recuse himself in any cases related to the 2020 presidential election and January 6th attack on the Capitol,” Durbin and Whitehouse wrote.

The senators reiterated their commitment to pursuing legislation to establish an enforceable ethics code for the Supreme Court if the Court and the Judicial Conference do not take meaningful action to resolve what they describe as an ongoing ethical crisis.
