
TALLAHASSEE, Florida — A federal judge in Massachusetts has narrowed the focus of a lawsuit involving Governor Ron DeSantis and others over Florida’s arrangement to fly migrants from Texas to Martha’s Vineyard in 2022. While dismissing DeSantis and state defendants from the suit, Judge Allison Burroughs allowed the legal challenge against the company behind the flights to proceed.
Limited Scope of Lawsuit
In her 77-page decision, Judge Burroughs cited “insufficient facts” linking DeSantis and other state officials to potentially illegal actions related to the flights. While the dismissal shields them from immediate legal repercussions, it does not rule out future litigation against DeSantis concerning the controversial flights that drew widespread attention amid criticism of President Joe Biden’s immigration policies.
Criticism of Flights Operator
Despite clearing DeSantis and state defendants, Judge Burroughs rebuked Vertol, the company paid $1.5 million to operate the flights. She highlighted evidence supporting claims that migrants were targeted based on their Hispanic ethnicity and condemned the practice of using vulnerable individuals for political purposes.
Response from DeSantis Administration
Jeremy Redfern, a spokesperson for DeSantis, welcomed the dismissal of the lawsuit against the governor, asserting that the flights were conducted lawfully and authorized by the Florida Legislature. The administration reaffirmed its commitment to addressing the border crisis and emphasized its readiness for future migrant relocation efforts.
Continued Legal Battle
The organization Lawyers for Civil Rights Boston, representing some of the migrants on the flights, hailed the ruling as a victory, signaling that private companies can be held accountable for aiding state actions that violate immigrants’ rights. The group pledged to pursue further legal action against all involved parties, including seeking additional evidence for potential future lawsuits against DeSantis.
Ongoing Debate
While Florida conducted subsequent migrant flights, including one to Sacramento in June of the following year, DeSantis hinted at the possibility of further operations. However, the legal battle surrounding the Martha’s Vineyard flights underscores the contentious nature of immigration policy and the complex legal landscape facing state initiatives.
