Federal Judge Denies Delay in Sen. Bob Menendez’s Corruption Trial

New York, NY — U.S. District Court Judge Sidney Stein has rejected a request from Sen. Bob Menendez’s legal team to delay the start of his corruption trial by two months. The request for the delay was based on the “unprecedented foreign-agent charge against a sitting Senator” and the extensive document review required. However, Judge Stein deemed the extension unnecessary, stating that the volume of discovery material was consistent with the parties’ expectations.

Unchanged Circumstances

Federal prosecutors opposed the delay request, emphasizing that the start date had not been opposed when announced in October, and there were no significant changes since then. The trial is scheduled to begin on May 6, and Menendez’s legal team sought a delay to commence in early July.

Discovery Volume Dispute

A discovery vendor’s inadvertent error misled Menendez’s legal team into believing they received 735 terabytes of discovery documents when, in fact, they received only three terabytes. Judge Stein noted that while three terabytes is substantial, it is a tiny fraction of what Menendez’s legal team believed they had to review.

Menendez’s Legal Battle

Sen. Bob Menendez faces federal charges of using his office to benefit New Jersey businesspeople and the government of Egypt in exchange for various perks. Federal prosecutors also allege that Menendez acted as a foreign agent on behalf of Egypt during his tenure as chair of the Senate Foreign Relations Committee. Menendez has pleaded not guilty to the charges and continues to maintain his innocence.

Potential Political Implications

The decision not to delay the trial may have political implications, as Menendez has not clarified whether he plans to run for reelection. The trial’s timing, starting in May, aligns with the Democratic Senate primary in early June. Menendez faces challenges from potential Democratic contenders, including first lady Tammy Murphy and Rep. Andy Kim. Christine Serrano Glassner, a New Jersey mayor with ties to former President Donald Trump, is running on the Republican side.
