Maine Democrats Threaten Electoral College Rules Change in Response to Nebraska Republicans

In response to potential changes to electoral college rules by Nebraska Republicans, Maine Democrats have issued a warning that they may take similar action to counteract the impact. The statement came from Maureen Terry, the state House majority leader, who stated that the Democratic-controlled Legislature would “be compelled to act in order to restore fairness” if Nebraska’s Republican governor signs legislation to make the state a winner-take-all election in 2024.

Current Electoral College System

Both Maine and Nebraska currently award a portion of their electoral votes based on which candidate wins individual congressional districts. This system could result in President Donald Trump winning one Electoral College vote from Maine and President Joe Biden winning one from Nebraska in the upcoming November election.

Nebraska’s Proposed Changes

Nebraska GOP lawmakers have proposed amending the current system to establish a winner-take-all approach, effectively eliminating the possibility for Biden to earn an electoral college vote by winning the state’s Omaha-district. The bill to implement this change has faced obstacles in the Legislature but has received support from Governor Jim Pillen, who is encouraged by Trump allies to push for a special session to pass the legislation.

Maine’s Response

Should Nebraska Republicans succeed in changing the electoral system, it would affect Biden’s path to reelection, particularly in crucial states like Michigan, Pennsylvania, and Wisconsin. Additionally, it would place pressure on Maine Democrats to respond by changing their system to a winner-take-all election, potentially depriving Trump of a likely electoral vote in the state.

Democratic Reaction

Previously, Maine Democratic lawmakers had not entertained such a scenario. However, Terry’s statement indicates a willingness to consider action if Nebraska proceeds with its plan. She emphasized the importance of fairness and playing by the rules in the electoral system, suggesting that the Maine Legislature would act to restore fairness if necessary.

Next Steps

Maine’s Legislature has adjourned, so any consideration of changing electoral rules would require a special session called by Democratic Governor Janet Mills. However, Terry’s remarks have been praised by national Democrats, signaling a potential shift in strategy.

Governor’s Response

As of now, Governor Mills’ office has not responded to requests for comment on the matter.
